On Friday, a federal court judge finally released reasons why Toronto.com, the Toronto Star-owned Web site that's been trying to put Ritchie Sinclair and his Toronto2.com Web site out of biz, was denied its application for an injunction against Sinclair in late January.
What of TorStar's charge that it "has acquired substantial goodwill and is entitled by virtue of common law to exclusive use of the trademark?"
The judge said TorStar "simply did not point to any clear evidence." Toronto.com's lawyer did not respond to a request for comment.
Toronto2.com's lawyer, Zak Muscovitch, says the case has inflicted grave financial hardship on Sinclair, who's recently been forced to move from his apartment.
