Current NAFTA Chapter 11 challenges filed against the government of Canada

S.D. Myers Inc. Ohio-based firm is challenging Canada’s ban on PCB exports to the U.S., where it runs a PCB treatment facility. A Chapter 11 tribunal recently ruled in the company’s favour. The Canadian government has appealed the decision to a federal court.

Pope and Talbot Inc. Portland-based forest products company, which runs sawmills in BC, claims that softwood lumber quotas are being applied unfairly by the Canadian government, favouring Canadian foresters over Americans doing business in Canada. A tribunal ruled in Canada’s favour on all counts except a minor “administrative” front, on which the company won damages still to be decided.

United Parcel Service of America (UPS) Inc. Atlanta-based courier company alleges that Canada Post, which runs its own courier services, has an unfair advantage over private courier companies by virtue of its mail service infrastructure.
